Terms & Conditions

Welcome to www.pikkol.com (the “Site”). By using this Site, and any publicly available versions of the Site that pikkol.com offers or co-brands with another party, you hereby agree that you are bound by and accept all of these terms and conditions of this user agreement ("User Agreement"). If you do not agree to the Terms and conditions, you must immediately cease all use of, or access to, the Site. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Rednile Innovations Private Limited (Owner of pikkol.com) relationship with you in relation to the Site and the Service (as described below) rendered through the site.

The term 'Pikkol' or 'us' or 'we' or the ‘Company’ refers to the owner of the Site, Rednile Innovations Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at Level 9, Raheja Tower, MG Road, Bangalore-560001, India. The term “User” or “you” refers to the user or viewer of the Site, individuals who call our phone number or the individuals who downloads, uses or views our mobile phone application (“App”).

User(s) Eligibility

User(s) means any individual or business entity/organization that legally operates in India or in other countries, uses and has the right to use the Services provided by Pikkol. Our Services (as described below) are available only to those individuals or companies who can form legally binding contracts under the applicable law. Therefore, user(s) must not be a minor as per Indian Law; i. e. user(s) must be at least 18 years of age to be eligible to use our Services.

Pikkol advises its users that while accessing the web site, they must follow/abide by the related laws. Pikkol is not responsible for the possible consequences caused by your behaviour during use of web site. Pikkol may, in its sole discretion, refuse the service to anyone at any time.

This agreement applies to user(s) if user(s) are visitors, registered - free or paid user(s) who access the web site for any purpose. It also applies to any legal entity that may be represented by you under actual or apparent authority. User(s) may use this site solely for their own personal or internal purposes.

This agreement applies to all Pikkol Services offered on the Site or App, collectively with any additional terms and condition that may be applicable to the specific service used/accessed by user(s). In the event of a conflict or inconsistency between any provision of the terms and conditions mentioned herein with those of the particular service, the provisions of the terms and conditions applicable to such specific Services shall prevail.

Pikkol Services

The Company operates the Site to provide online listing, advertising and lead generation services (the "Services") for companies who have entered into a Vendor Agreement with us ("Vendors"). The site facilitates the Users to seek and obtain quotes or other information from Vendors. Vendors may offer certain products and services to Users, including, but not limited to, packing, unpacking, moving, storage, carrier, brokerage, insurance, mortgage, and other related services ("Relocation Services"). In order to obtain quotes or other information about Vendors' Relocation Services, you must fill out and submit the forms provided on the Site or App

("Enquiry"). You agree that you will not submit an Enquiry unless you intend, in good faith, to obtain the requested Relocation Services within ninety (90) days of submitting the Enquiry.

After you submit an Enquiry, Pikkol will furnish quotes from Vendors who submits quotes for relocation needs specified in your Enquiry. Pikkol is free to identify the vendors to whom the Enquiry has to be sent at its own discretion determines in its sole discretion. After Pikkol.com selects the Vendors, Pikkol will: (a) intimate you by sending you e-mails or notifications identifying the selected Vendors, and (b) share your User Information (as defined below) with the selected Vendors. By submitting an Enquiry, you are not obligated to obtain any products or services from any Vendors.

Pikkol utilizes an auto-save feature on the Enquiry form, in that when you fill out your personally identifiable information, the information is captured and stored on our servers. If you do not complete the Enquiry form and submit it, a Pikkol representative, and only a Pikkol representative, will utilize your personally identifiable information to contact you solely for the completion of your form. A Pikkol representative will submit the Enquiry form on your behalf electronically upon your verbal consent.

If you call Pikkol using our phone number listed on the Site, a Pikkol representative will, upon your verbal consent, use your personally identifiable information to fill out and submit the Enquiry form online. Please note that Pikkol does not hold any liability for any referrals verbally or otherwise given by Pikkol representatives. It is up to the customer to discern any pertinent information from third party companies (“Vendors”) and the privacy policies thereto.

Vendors are prohibited from using your User Information for any purpose other than to contact you to provide a quote and other information about their Relocation Services. However, you acknowledge and agree that Pikkol is not affiliated with and does not control the commercial activities of any Vendor and cannot ensure that Vendors will not use your information in unintended ways. We therefore recommend that you directly contact each Vendor to obtain information about the Vendors' privacy practices, or review the Vendor's privacy policy posted on its website, if any, in order to understand that Vendor's collection, use and disclosure of your information.

All information related to packing, assembling, relocation etc. given on the Site is for general use. These are not prescriptive in nature and the information given in the articles must be used at your discretion, as Pikkol and our content team are not held responsible for the information provided in the articles. Furthermore, these are not meant to be endorsements.

Relocation

Please note that Pikkol does not provide any Relocation Services and is not a party to any transaction between a Vendor and any User. Pikkol through its agents or employees have verified the Vendors listed on the Site and has entered into Vendor Agreements with the Vendors to ensure quality of Relocation Services rendered by them. However, you acknowledge that, Pikkol, does not directly or indirectly control the Vendor or Vendor’s agents and cannot be held responsible for their actions or refusal to comply with requests made by the customer. As such, Pikkol cannot and does not (a) guarantee or ensure the quality of any Vendor, any transaction between a User and a Vendor, or the Relocation Services of any Vendor, (b) endorse or recommend any Vendor or any specific product or service of any Vendor, or (c) offer for sale, sell or otherwise provide any Relocation Services.

The Users acknowledge that the quote provided by Vendors for Relocation Services requested by the User is provided with the understanding Vendors gain, from the Enquiry submitted by Users. Pikkol cannot be held responsible for any lack of information due to the inaccuracy in the form or deficiencies in the form presented in the Site or App. Vendors are responsible for the price quoted and are solely responsible for any changes in pricing arising out of new understanding derived after visiting the User premises. Pikkol has advised the Vendors against any price changes once the quote has been submitted. Yet, Pikkol in no way can be held responsible for any changes or actions taken by the Vendor on any particular matter pertaining to but not limited to packing, unpacking, assembling, disassembling, price revisions, and conduct of Vendor’s agents or employees. Changes or alterations to the Enquiry may result in changes to service terms including but not limited to pricing.

The User warrants that any goods removed or stored under the contract are owned by the User, or that the User has full right, power and authority to allow such removal or storage. The User shall indemnify the Vendor against any claim arising or expense incurred as a result of any breach of this warranty. The User shall not give to the Vendor for packing, removal or storage any article or substance which is, or is likely to be, of a dangerous, corrosive, inflammable, explosive or damaging nature, or anything likely to encourage vermin or any other pest. The Vendor has the right to reject the request to carry certain items the Vendor considers inappropriate for transfer. The User shall not force the Vendor to accept any goods that Vendor is not ready to transport. The User shall indemnify the Pikkol against all claims in respect of such goods.

The User will notify the Vendor if there is not suitable and convenient access to the place from which the goods are to be removed. The User(s) warrant that the property to or from which goods are removed by the Vendor is owned by the User or that the User has obtained prior to the commencement and carrying out of the work by the Vendor all necessary permits and approvals and authorizations to enable the Vendor’s vehicles, agents and/or employees to enter such property with or without vehicles for the purposes of carrying out the Vendor’s obligations hereunder and the User hereby indemnifies the Pikkol in respect of any loss, claim or damage suffered, brought against or caused by the Vendor in entering upon such property with or without vehicles.

Unless expressly agreed otherwise in writing and unless the relevant provisions of the Carriage of Goods Act in that regard (where applicable) have been fully complied with, all goods will be carried and stored at owner’s risk. Pikkol shall be under no liability for any loss of or damage to the goods, howsoever arising or caused, whether direct, indirect or consequential and whether or not the same was reasonably foreseeable or known by the Vendor to be probable. It is the Users responsibility to arrange the appropriate insurance if required. Pikkol or its agents or vendors make no representations and gives no advice regarding any aspect of the policy, including as to the suitability or appropriateness of the policy for the User’s requirements, the policy’s terms, conditions and exclusions or as to the competitiveness of the cost (which includes a fee component retained by the Contractor). The Customer warrants that he/she relies solely on his/her own skill and judgment in accepting the policy on the terms offered. Pikkol in no way can be held responsible damages or losses arising out of inaccuracies or lack of judgment on the part of the user in choosing the right insurance or in the inaccuracies in declaring the value or inventory of items, as the User is solely responsible for declaring the right value of goods as they deem necessary.

The users may choose to make full, part or no payment through the site or App as they desire. While making the full payment, the users acknowledge that the Pikkol has accepted the payment on behalf of the Vendor, Pikkol can only direct the Vendor to provide Relocation Services and Pikkol does not have any obligation to render the Relocation Services. When the customer makes part or no payment on the Site or App, payment is expected to be made to the Vendor as per the terms between the User and the Vendor.

Third-Party Websites; Linking

The Site may contain links to websites owned or operated by third-parties, including Vendors' websites, that are not affiliated with, established or supervised by Pikkol. Pikkol does not endorse, sponsor or otherwise make any express or implied warranty or guarantee the websites linked to or from the Site or the accuracy, completeness or appropriateness of any information appearing on such linked websites, and Pikkol is not responsible in any way for any advice, content, information, practices, products or services related or made available through such linked websites. Similarly, Pikkol is not responsible for any advice on or verbal referral of a third- party website or company by any Pikkol representative. It is up to the customer to discern any pertinent information regarding any third party company’s products, services and practices and contact the third party company directly.

Site Content, Trademarks, and Software

All information, data and content made available on the Site (collectively, the "Content") is protected by copyright, trademark and other applicable intellectual property laws. The Content is owned by Pikkol, its licensors, suppliers, affiliates, or others. The Content is intended solely for your personal and noncommercial use. You may interact with or download a copy of any portion of the Content for your personal and noncommercial entertainment, information or use, provided that you shall not reproduce, sell, publish, distribute, modify, publicly display, publicly perform, re-post or otherwise use the Content, in whole or in part, in any other way or for any other reason without the prior written consent of Pikkol.

You acknowledge that the Content includes certain trademarks and service marks owned by the Company, its licensors, suppliers, affiliates, or others. You agree not to copy, use or otherwise infringe, misappropriate, dilute or violate these trademarks or service marks. In addition, you agree that you will not alter or remove any trademark, copyright or other notice from any copies of the Content. The PIKKOL name and logo are trademarks of the Company. You acknowledge that other product and company names appearing on the Site may be trademarks of their respective owners.

Please note that all software programming, including without limitation all HTML and other code contained on the Site (collectively, "Software"), is owned by the Company, its licensors, suppliers, affiliates, or others and is protected by copyright laws or other applicable intellectual property laws, as well as international treaty provisions. Any unauthorized access to, or reproduction, advertisement, redistribution, publication, display or other use of the Software is expressly prohibited by law and may result in severe civil and/or criminal penalties. Violators will be prosecuted to the maximum extent possible.

User Information

By submitting an Enquiry or other materials containing personal information, including without limitation your name, address, phone number, e-mail address, your image or likeness, as well as your Relocation Services needs ("User Information"), you hereby expressly grant Pikkol a royalty-free, perpetual, non-exclusive right and license, with right to transfer and sublicense, to copy, modify, display, distribute, publicly perform, create derivative works of, and otherwise use and exploit any such User Information in any form, media, software or technology of any kind now existing or hereafter developed for the purposes described in this User Agreement and in accordance with the Privacy Policy.

Given the nature of the Site and the volume of information, postings, and other content submitted on the Site, Pikkol cannot and does not actively monitor all of the User Information or information submitted by other Users, Vendors or other third-party information providers. Therefore, Pikkol reserves the right, in its sole discretion, to monitor, refuse to publish, refuse to transmit, remove, delete, move or edit any User Information or other posted information without notice, at any time and for any reason. By using the Site, you expressly agree that Pikkol will not be liable for (a) any claims, actions or judgments arising out of or related to any User Information or other posted information, or (b) monitoring, refusing to publish, removing, deleting, moving or editing any User Information or other posted information without notice at any time and for any reason.

Copyrights, Copyright Agents and Compliance

Pikkol maintains a policy whereby it responds to notices of claimed intellectual property infringement. In the event that Pikkol receives a notice of alleged infringement, it will promptly investigate all such notices and take appropriate actions.

In order to be effective, any notice of claimed infringement must be a written communication sent to admin@pikkol.com and must include the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity that is to be removed or access to which is to be disabled; and information reasonably sufficient to permit the service provider to locate the material;

4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address at which the complaining party may be contacted;

5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner; its agent or the law; and

6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Representations and Warranties; Indemnity

You hereby represent and warrant that (a) you have all necessary authority, rights and permissions to submit the User Information to the Site, (b) the User Information does not and will not infringe, misappropriate, dilute or otherwise violate any copyright, trademark, trade secret, patent or other intellectual property right of any third party, including any rights of privacy or publicity, (c) the User Information is accurate, complete, true and honest, (d) the User Information does not and will not violate any applicable law or regulation or cause injury to any person, and (e) neither you, nor any party that you are representing, (i) is in the business of providing Relocation Services and/or, (ii) is using the Site for the purpose of obtaining the quotes or other information about your competitors.

You agree to release, defend, indemnify and hold the Company, Pikkol, its affiliates, licensors and suppliers, their respective officers, directors, employees, agents and contractors harmless from and against any and all claims, costs, demands or expenses, including attorneys' fees, arising from (i) any distribution, publication, refusal to publish, removal, deletion, movement, editing or other use of the User Information you provide, (ii) your use of the Site or any reliance on the Content, (iii) your breach of this User Agreement, or (iv) any actual, prospective or terminated transaction between you and a Vendor or any other third party.

Prohibited Activities

The following is a partial list of the kinds of activities that are prohibited on or through the Site: (i) engaging in activity or submitting User Information that harasses or advocates harassment of another person, (ii) engaging in activity that involves the transmission of "junk mail" or unsolicited mass mailing or "spam" to Users, Vendors, or others, (iii) engaging in activity or submitting User Information, or promoting information, that is fraudulent, false, dishonest, or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous, (iv) using the Site's forms and/or toll-free numbers to advertise or promote products and services to Pikkol advertisers or Vendors, (v) using any robot, spider, bot or other automatic device, or manual process, to monitor or copy web pages or the Content contained on the Site or for any other unauthorized purpose without the prior written consent of Pikkol, (vi) using any device, software or routine to interfere or attempt to interfere with the proper working of the Site, (vii) decompiling, reverse engineering, disassembling or otherwise attempting to obtain the source code for the Software, (viii) taking any action that imposes an unreasonable or disproportionately large load on Pikkol's hardware or software infrastructure, or (ix) using this Site for the purpose of obtaining quotes or other information of your competitors (collectively, the "Prohibited Activities").

Disclaimer of Warranties

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

YOU EXPRESSLY AGREE THAT USE OF THE SITE AND RELIANCE ON THE CONTENT IS AT YOUR OWN RISK. TO THE EXTENT PERMITTED BY LAW, PIKKOL, ITS AFFILIATES, LICENSORS, AND SUPPLIERS DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE SITE, THE SOFTWARE, THE CONTENT, OR THE USER INFORMATION OR YOUR USE OF ANY OF THE FOREGOING. THE SITE, THE SOFTWARE, THE CONTENT, THE USER INFORMATION AND THE SERVICES ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS, AND PIKKOL, ITS AFFILIATES, LICENSORS, AND SUPPLIERS SPECIFICALLY DISCLAIM ANY AND ALL EXPRESS OR IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, WARRANTIES OF MERCHANTABILITY AND WARRANTIES OF NON-INFRINGEMENT.

ALL INFORMATION RELATED TO VENDORS AND THE PRODUCTS OR SERVICES AVAILABLE ON AND THROUGH THE SITE IS SUPPLIED BY THE VENDORS OR OTHER THIRD PARTIES. PIKKOL, IT'S AFFILIATES, LICENSORS, AND SUPPLIERS MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, TO ANY ACTUAL OR PROSPECTIVE PURCHASER OF PRODUCTS OR SERVICES AS TO THE EXISTENCE OR QUALITY OF THE PRODUCT OR SERVICE, THE ACCURACY OF ANY VENDOR QUOTE RECEIVED THROUGH THE SITE, THE QUALITY OF ANY PRODUCTS OR THE VENDOR'S PERFORMANCE OF SERVICES, ANY VENDOR'S COMPLIANCE WITH APPLICABLE LAWS, OR THE VENDOR'S COMPLIANCE WITH THE TERMS OF PIKKOL'S PRIVACY POLICY. PIKKOL RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CORRECT ANY ERROR OR OMISSION ON THE SITE OR IN THE CONTENT. ANY AND ALL CONCERNS, CLAIMS, OR DISCREPANCIES REGARDING A QUOTE FROM A VENDOR, THE PRODUCTS OR SERVICES PROVIDED BY A VENDOR, OR THE VENDOR'S USE OR DISCLOSURE OF YOUR USER INFORMATION, MUST BE ADDRESSED DIRECTLY WITH THE VENDOR. PIKKOL DOES NOT MAKE ANY AND EXPRESSLY DISCLAIMS ANY REPRESENTATIONS, WARRANTIES OR GUARANTEES THAT, BY USING THE SITE, YOU WILL OBTAIN ANY PRODUCTS OR SERVICES, YOU WILL ONLY RECEIVE QUOTES FROM LEGITIMATE VENDORS, OR THAT THE VENDORS WILL NOT SELL OR DISCLOSE YOUR USER INFORMATION TO THIRD PARTIES.

Limitation on Liability

TO THE EXTENT PERMITTED BY LAW, PIKKOL, ITS AFFILIATES, LICENSORS, AND SUPPLIERS, THEIR EMPLOYEES, AGENTS, CONTRACTORS AND THIRD-PARTY LICENSORS SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES OR LOSSES INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, RESULTING FROM OR CAUSED BY THE SITE, THE SOFTWARE, THE CONTENT, THE USER INFORMATION, THE SERVICES PROVIDED BY PIKKOL, THIS USER AGREEMENT OR OTHERWISE (INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM NEGLIGENCE). IN NO EVENT WILL THE AGGREGATE MAXIMUM LIABILITY OF PIKKOL, ITS AFFILIATES, LICENSORS, AND SUPPLIERS, THEIR OWNERS, EMPLOYEES, AGENTS, CONTRACTORS AND THIRD- PARTY LICENSORS FOR ANY CLAIM EXCEED INR 100,000/-. FOR PURPOSES OF THIS LIMITATION ON LIABILITY, THE TERM "THIRD-PARTY LICENSOR" DOES NOT INCLUDE YOU.

Termination

You understand and agree that, in Pikkol's sole discretion, and without prior notice, Pikkol may terminate or suspend your access to the Site, and Pikkol may exercise any other remedy available and remove any User Information, if Pikkol believes that your use of the Site and/or any User Materials you provide (a) violate (i) this User Agreement, (ii) the rights of Pikkol, its affiliates or licensors, or another User of the Site, or (iii) any law or regulation, or are otherwise objectionable or inappropriate, or (b) constitute fraudulent activity of any nature. You agree that monetary damages may not be an adequate remedy to Pikkol for violations of this User Agreement, and you consent to injunctive or other equitable relief for such violations without the requirement that Pikkol post a bond.

General Terms

The Company may change, modify, amend, or update this agreement from time to time without any prior notification to user(s) and the amended and restated terms and conditions of use shall be effective immediately on posting. If you do not adhere to the changes, you must stop using the service. Your continued use of the Site after the posting of any amended User Agreement shall constitute your agreement to be bound by any such changes. Pikkol may modify, suspend, discontinue or restrict the use of any portion of the Site without notice or liability. This Agreement will be governed by and construed in accordance with the laws of India. The courts of Bangalore will have exclusive jurisdiction to decide any dispute that arises out of this agreement. If for any reason a court of competent jurisdiction finds any provision of this User Agreement illegal, invalid or otherwise unenforceable, such provision shall be severed and the entire agreement shall not fail on account thereof, the other terms of the agreement will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this User Agreement will continue in full force and effect. Failure by Pikkol to enforce any provision of this User Agreement will not be deemed a waiver of future enforcement of that or any other provision of this User Agreement. The User Agreement constitutes the entire agreement between the parties regarding the subject matter hereof. Neither this User Agreement, nor any terms or conditions contained herein, shall be construed as creating a partnership, joint venture or agency relationship or granting a franchise between the parties.
